Fees & Funding
Clear information about fees and funding will be provided at the outset of every matter.
Each case is assessed individually. The appropriate structure will depend on the type of proceedings, the complexity of the issues, and whether representation is required for a single hearing or ongoing litigation.
Instructions are accepted from both solicitors and members of the public under the Public Access scheme.
Private Fee-Paying Clients
Most cases are privately funded.
Fees are typically structured in one of the following ways:
Fixed Fees (Where Appropriate)
For clearly defined stages of work, fixed fees may be available. This may include:
- Advice conferences
- Written opinions
- Drafting of applications or pleadings
- Representation at a specific hearing
- Brief advice on prospects
Fixed fees provide clarity and cost certainty.
Brief Fees for Hearings
Where representation at court is required, fees are usually agreed in advance for:
- Preparation
- Attendance at court
- Advocacy
If a hearing exceeds its anticipated duration, additional fees may apply, which will be explained clearly in advance.
Ongoing Litigation
Where a matter proceeds through multiple stages, fees may reflect:
- Preparation time
- Drafting
- Conferences
- Hearings
- Procedural management
Where authorised to conduct litigation, proceedings may in suitable cases be managed without separate solicitor involvement. In more complex matters, additional solicitor involvement may be advisable.
Direct Access Funding
Where instructed under the Public Access scheme:
- Fees will be agreed in writing before work begins.
- Scope of work will be clearly defined.
- Payment arrangements will be set out transparently.
Clients are responsible for managing aspects of the case administration unless litigation is conducted directly by authorised counsel.
Legal Aid
Legal Aid cases may be accepted where clients are referred via solicitors and eligibility criteria are met.
Public Access instructions are generally privately funded.
Transparency and Cost Awareness
At the outset of each matter, clients will be informed of:
- Scope of work
- Fee structure
- Likely next stages
- Anticipated additional costs
If circumstances change, fee implications will be discussed promptly.
